Can a minor open a numismatic dealing account or sell notes on online platforms?
A minor cannot independently open a numismatic dealing account, register for GST as a dealer, or sell on online platforms — all of these require legal capacity to contract, which minors do not have until they turn 18. Platform terms of service (Instagram, Facebook, YouTube, WhatsApp) universally require users to be at least 13 (for basic access) or 18 (for commercial activity). A minor's sales on these platforms are on void contracts. The practical route for a commercially active minor collector is for a parent or guardian to conduct the dealing operation in their own name, with the minor assisting.
Online platform terms and minors
The terms of service of every major platform used for numismatic trading — Instagram, Facebook, WhatsApp, YouTube — require users to be at least 13 for basic access and 18 for commercial activity (buying and selling). A minor who lists notes for sale on Instagram is violating the platform's terms, and any sale contracts entered into through the platform are void under ICA Section 11. The platform can close the account; the buyer has no binding contractual claim; and the minor has no enforceable right against a buyer who refuses to pay.
GST registration — not available to minors
GST registration requires a PAN card and a declaration of capacity to carry on business. While PAN cards can technically be issued to minors (with guardian details), GST registration as an active dealer is a business activity that requires contractual capacity. A minor cannot independently register for GST and carry on a dealing operation — the registration application requires a declaration of eligibility to enter into agreements, which minors cannot make. The GST department would register the guardian, not the minor.
Bank accounts for dealing
A minor can hold a savings account (with guardian as joint holder under most bank policies). A current account for business transactions — the account type typically used by dealers for high-volume trading — requires the account holder to be 18 or over. A minor cannot open an independent current account for their dealing operation.
The guardian operation — the correct legal route
For a minor who has a genuine dealing operation — buying, grading, cataloguing, and selling notes with real commercial activity — the correct legal structure is for the parent or guardian to conduct the business in their own name. The guardian registers for GST, opens a current account, enters contracts, and issues invoices. The minor assists with the practical work: photographing notes, preparing listings, managing the catalogue. Revenue flows to the guardian's account. Income tax is filed by the guardian. This is legally clean: all contracts are valid, all obligations are enforceable.
The income tax dimension: if the minor is genuinely contributing to the business and the business is structured as the guardian's proprietorship, the income is the guardian's. If the minor's collection is being sold and the proceeds are the minor's income, the clubbing provisions of ITA Section 64(1A) may apply — income from a minor's assets may be clubbed with the higher-income parent's returns. A CA should advise on the specific structure.
