Can deleted WhatsApp messages from an auction still be used as legal evidence?
Yes — deleted WhatsApp messages can still be used as legal evidence through three survival mechanisms that deletion does not affect. First: if any party exported the chat before deletion, the export contains the deleted messages. Second: WhatsApp cloud backups (Google Drive or iCloud) capture messages at backup time — messages deleted after the last backup still exist in the backup. Third and most important: in a group auction, deletion by one member does not delete the message from any other member's phone. In a 50-person WhatsApp group, the seller's deletion is entirely irrelevant — 49 other devices still have the message.
Why deletion does not destroy evidence in group chats
WhatsApp's delete function has two modes: 'Delete for me' removes the message from the deleting person's device only. 'Delete for everyone' requests that other participants' devices also remove the message — but this only works for messages deleted within a time window (currently approximately 60 hours of original posting). For older messages, 'delete for everyone' is not available. And even 'delete for everyone' sends a notification to other participants — replacing the message with 'This message was deleted' — which itself is evidence that a message existed and was deleted.
In a WhatsApp group auction where bids are posted publicly, every group member received each message when it was posted. The seller deleting their own 'sold to Rahul' message from their device does not delete it from Rahul's device or from any of the other 48 group members' devices. The message is gone from the seller's phone — not from the evidence.
The three survival mechanisms
Mechanism 1 — Chat export: WhatsApp's Export Chat function (Settings > Chats > Export Chat) produces a text file containing all messages with timestamps and sender names. Any participant who exported the chat before or after deletion has a complete record. The export file is admissible under BSA 2023 Section 61 as an electronic record.
Mechanism 2 — Cloud backup: WhatsApp backs up chats to Google Drive (Android) or iCloud (iPhone) at the frequency set by the user — daily, weekly, or monthly. A message that was deleted after the last backup still exists in the backup. Court orders have been used to obtain WhatsApp backup data from cloud storage providers in criminal investigations.
Mechanism 3 — Other participants' devices: As discussed — in a group, deletion by one member is irrelevant to every other member. Other participants can be asked to provide their version of the chat as evidence. In a consumer forum proceeding, a member of the numismatic group who witnessed the auction can provide their device's version of the chat as supporting evidence.
