Can you demand the original agreed item AND a refund simultaneously, or must you choose one?

The Simple Truth

Under the Consumer Protection Act 2019 and the Indian Contract Act 1872, you can demand either specific performance (delivery of the correct item) or damages (refund), but not both simultaneously for the same deficiency. However, you can combine a primary remedy with compensation — demand the correct item FIRST, and if it is unavailable, demand a full refund PLUS compensation for mental agony and the costs of having been sent the wrong item. The two primary remedies are alternatives; compensation layers on top of whichever primary remedy is granted.

Specific performance vs damages — the contract law structure

Indian contract law provides two remedies for breach: specific performance (compelling the promisor to perform exactly what was promised) and damages (compensating the promisee for the loss caused by non-performance). These are alternatives, not cumulative. You cannot compel a dealer both to deliver the specific note AND to refund the price — that would give you the note and the money, which is unjust enrichment.

The Consumer Protection Act 2019 Section 39(1) reflects this structure: the forum can order removal of deficiency OR replacement of goods OR return of price (refund). These are alternative primary remedies. The forum decides which is appropriate based on the circumstances.

The practical approach — primary remedy plus compensation

The most effective approach in a consumer complaint is: demand the correct item first (specific performance — if available); state that if the correct item is unavailable, you seek a full refund plus compensation. This preserves both options. If the dealer can still supply the correct item and the forum orders delivery, you get what you originally contracted for. If the item is unavailable — rare error notes often are — the forum awards the refund plus compensation.

In either case, you can seek compensation for mental agony, harassment, and litigation costs in addition to the primary remedy. These are not a second refund — they are a separate compensation for the inconvenience caused by the deficiency. A forum order that says 'refund ₹10,000 plus ₹8,000 for mental agony plus ₹3,000 litigation costs' is a total award of ₹21,000 on a ₹10,000 transaction — entirely within the forum's power under Section 39(1).
