Can you get compensation beyond just a refund — such as for mental harassment and wasted time?
Yes — consumer forums under the Consumer Protection Act 2019 can and routinely do award compensation beyond the refund of the purchase price. Section 39(1)(d) specifically empowers forums to award 'compensation to the consumer for any loss or injury suffered by the consumer due to the negligence of the opposite party.' This includes mental agony, harassment, time and effort spent in pursuing the complaint, and costs of litigation. In cases of deliberate fraud, punitive damages are also available.
Section 39 — the complete remedies menu
Section 39(1) of the Consumer Protection Act 2019 lists what a consumer forum can order. The full menu includes: remove defect or deficiency; replace goods; return the price paid (refund); award compensation for any loss or injury including mental agony; withdraw hazardous goods from sale; cease and desist from unfair trade practices; pay punitive damages in cases of gross negligence or deliberate fraud; and pay adequate costs to the complainant.
For a numismatic dispute, the typical compensation order contains three components: the refund of the purchase price (the core remedy); compensation for mental agony and harassment (an additional amount reflecting the stress and inconvenience caused by the dealer's deficiency); and costs of litigation (advocate fees, forum fees, and the cost of pursuing the complaint).
The quantum — how much do forums actually award?
There is no fixed formula for mental agony compensation. Consumer forums exercise discretion based on the facts. In typical numismatic disputes, mental agony compensation ranges from ₹5,000 to ₹25,000 for straightforward cases. Where the dealer's conduct was particularly egregious — deliberate fraud, repeated deception, or organised scamming — forums have awarded ₹25,000 to ₹50,000 or more. The nature and severity of the deficiency, the dealer's conduct during the complaint process, and the complainant's demonstrated distress all influence the quantum.
Interest on the delayed refund is a separate component. Forums routinely award interest at 9% to 12% per annum on the purchase price from the date of the transaction to the date of refund. For a ₹10,000 purchase where the dealer delayed refund by 2 years during litigation, 10% annual interest adds ₹2,000 to the compensation. Costs of litigation — typically ₹2,000 to ₹10,000 — are also separately awarded.
